There are a number of resources available to prepare for an unemployment hearing before the New York State Unemployment Insurance Appeal Board (“UIAB”). I regularly consult the following as part of my preparation:
- Appeal Board Decision Search – Decisions of the UIAB since 2009 can be accessed electronically. Prior decisions are available in paper form at the UIAB Law Library.
- Appeal Board Rules
- Interpretation Index – This is an index, created by the Department of Labor – of the most relevant case law decisions.
- Unemployment Prevailing Wage – Used in job refusal cases to see if the refusal was with good cause
- Attorney List for Claimants – These attorneys/representatives regularly appear on behalf of claimants before the UIAB.
